Please Note:

These Terms and Conditions are a summary from our Rental Agreement which you will be asked to agree to and sign during the booking process

By submitting your reservation, you are agreeing to the “Terms and Conditions”, whether by ticking the box online or verbally consenting over the phone or in an email.

Your submission of personal information establishes a contractual understanding between me (Karen Faulkner and MK Vacay) and the individual who made the online booking. In return, we will secure the accommodation for the specified dates requested in your reservation.

If you are unable to pay via Credit Card then you will need to contact us to discuss payment by bank transfer.

Payment

Deposit: A deposit of 75% of the reservation balance is due upon booking, payable by Credit Card.

Balance Due: An automatic credit card payment for the remaining balance will be scheduled by the Owner to be made 30 days prior to the arrival date. (See No. 5 of Rental Agreement) 

Security Deposit: A security deposit is required and will be automatically reserved for the booking. The automatic reserve is conducted by putting a hold on the Guest’s credit card for the amount of $1,000.00 exactly 2 day(s) prior to the arrival date. (See No. 6 of Rental Agreement)
 
 

Changes to Dates / Cancellation

Changes to Dates

In the event that you would like to change the dates of your booking, we will endeavor to accommodate you without any additional administration charges.

  • Changes to dates in higher nightly rate periods will be subject to the higher rental charge.
  • Changes to dates in lower nightly rate periods made within 6 (six) weeks of the start of the rental period, will only be subject to the lower charge if we can re-book the initial higher rate period.

 

Cancellation by You

We strongly recommend obtaining travel insurance to protect against unexpected weather conditions or unforeseen life events as we do not provide refunds in the event of weather-related issues or sickness, and the likes. Additionally, insurance options now include coverage for Covid-19-related circumstances.

Kindly, we request that the party who originally made the booking communicates their cancellation via email to mkvacayllc@gmail.com.

The refund policy is as follows: (See No. 4 of Rental Agreement) 

  • One hundred percent (100.00%) of the total booking charges will be refunded if the cancellation is made more than 60 days prior to the arrival date of the reservation. 
  • Fifty percent (50.00%) of the total booking charges will be refunded if the cancellation is made more than 30 days prior to the arrival date of the reservation.  
  • NO refund will be issued for cancellations made within 30 days prior to the arrival date.

 

Cancellation by Us

While we do not anticipate needing to modify your reservation, unforeseen issues can arise that may require us to make adjustments or, in rare instances, cancel a booking.

If, for a valid reason, we are unable to make the Rental Property available, we will promptly get in touch with you to communicate any changes to your booking at no extra cost. If necessary, we may have to cancel the reservation, and in such cases, we will provide a complete refund of all payments made under the Agreement. (See No. 13 of Rental Agreement) 

  

Liability

The Rental Property may offer access to recreational and water activities, including but not limited to canoes, firepit, bicycles, and swimming. The inherent terrain of a mountain house means that there could be steep slopes or retaining walls and guests are to use all due caution to avoid injury by staying clear of steep areas and keeping off of retaining walls, as well as not traversing steeply sloped terrain that may
be on or near the property without understanding that there may be risks involved. Guest fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Guest holds harmless the Owners for any injury caused by a person or pet outside of his control such as a neighbor. Guest holds harmless the Owners for any wildlife that may be present in the area as this would be outside of their control. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless the Owner and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owners, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assume all risks and
dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owners or by any other person. Guest hereby voluntarily agrees to release, waive, discharge, hold harmless, defend and indemnify Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies Owner from any and all claims arising from such other persons.

Arrivals/Departures

Arrival

The standard check-in time is 4 pm, unless there have been specific or special arrangements made. You can do a self check-in by using the code we will send to you one hour prior to your scheduled check-in time. Please make sure you have received the code before you travel. 

 

Departure

Check-out time is strictly 10am. If you require a later check-out, we’ll do our best to accommodate it. But please bear in mind you’ll need to let us know beforehand.

 

General

Any unauthorized late arrivals/departures may be subject to a charge of $10 per hour. 

The evening before your departure we will send you a short list of check-out instructions, please check your email.

Parking

Our property can accommodate up to four average-sized cars in the driveway, and on-street parking is not available. Parking on the street will result in towing at the guest’s expense. If you anticipate having more than four cars, please inform us in advance, and we will gladly provide guidance on alternative parking arrangements.  (See No. 17 of Rental Agreement)

 

 

Lost Property

We are happy to return items that have been left following departure. However, guests are responsible for all shipping costs for any Lost and Found items that Owner is requested to return to Guest. A fee of $20 may be billed for returning lost items in addition to shipping costs. 

Items found and not claimed within 30 days will be disposed of at the discretion of Owner. (See No. 11 of Rental Agreement)

Smoking

Our home maintains a strict smoke-free policy, extending to both the indoor and outdoor areas surrounding the property. This prohibition encompasses the use of any smoking substances, including vaping.

To accommodate family members who smoke, we have established a single designated area for smoking – the firepit. Adherence to responsible smoking practices is crucial, encompassing the proper disposal of cigarette butts in assigned receptacles and a commitment to leaving no cigarette butts on the ground or within the firepit to mitigate the risk of fire hazards.

This comprehensive policy aims to ensure a safe and smoke-free environment for all residents. Violations may incur a $500 fine, with the responsibility for compliance resting on all family members and visitors.

Damages

We understand that sometimes accidents happen! Should you break anything or if something gets stained, please let us know immediately. Failure to do so may result in a forfeiture of your security deposit. (See No. 6 of Rental Agreement)

Pets

Guests must obtain permission from the Owner to have pets on the Property. Pets are allowed up to 2 well-behaved, vaccinated, potty trained dogs and must be approved prior to booking with $100 fee for each.  Only dogs are allowed and no other types of pets are allowed. 

Proof of rabies vaccination and flea control must be provided prior to your visit. Damages caused by your pets will be billed separately. (See No. 8 of Rental Agreement)

 

Cellular Service

Cell phone service is typically spotty in this high elevation area and is not guaranteed. There is no landline. Calls can be made using the Wi-Fi calling and is very reliable with the Wi-Fi calling at the house. Cellular service is not reliable once you enter the neighborhood and until you enter the house and connect to Wi-Fi so we recommend screenshotting your directions to the house prior to starting the climb up into the neighborhood. (See No. 17 of Rental Agreement)

 

Security

A smart doorbell camera with video that is triggered by motion is positioned outside faces the driveway for safety. Tampering with or covering cameras will result in immediate termination of stay without refund. (See No. 17 of Rental Agreement)
